This page sets out our Privacy Notice, our Cookie Policy, and the Terms of Use for this website.
Privacy Notice
1. Who we are
Ingent Consulting Engineers Limited (“Ingent”, “we”, “us”, “our”) is the data controller for the personal information described in this notice.
- Registered office: Unit 8 Opus Park, Exchange Place, Old Ipswich Road, Claydon, Suffolk, IP6 0FU
- Registered in England and Wales, company number: 09120483
- ICO registration reference: ZB902027
- Data protection contact: info@ingent.co.uk, 01473 598038
We are a civil and infrastructure engineering consultancy. This notice explains what personal information we collect, why we use it, who we share it with, and what rights you have.
2. The information we collect
If you contact us through this website, we collect your name, email address, telephone number, the subject and content of your message, and your stated preference for how we contact you.
If you are a client, or a contact at a client, consultant or contractor, we collect your name, job title, employer, work contact details, and correspondence relating to projects we work on together.
If you are a landowner, site owner, neighbour or other party connected to a site we are engaged on, we may hold your name, address and contact details, along with correspondence relevant to the project.
If you apply for a job with us, we collect the information in your CV and covering letter — including your employment history, qualifications, professional memberships and references — plus anything you tell us during the recruitment process.
We do not deliberately collect special category data (such as health, ethnicity or trade union membership). If you volunteer such information — for example about a health condition affecting site access, or an adjustment you need during recruitment — we use it only for that stated purpose.
3. Why we use it, and our lawful basis
| What we do | Lawful basis |
|---|---|
| Respond to enquiries made through the website, by phone or by email | Legitimate interests — responding to someone who has approached us about our services |
| Deliver engineering services, manage projects and correspond with you | Contract where you are our client; legitimate interests where you are a contact at a client or another party to the project |
| Submit designs, applications and supporting information to local planning authorities, highway authorities, water authorities and other approving bodies | Contract and legitimate interests — this is how the work gets approved (see section 4) |
| Send invoices, take payment and keep accounting records | Contract and legal obligation |
| Keep records to defend against professional negligence claims | Legitimate interests — protecting our legal position |
| Comply with statutory duties including tax, health and safety, and the CDM Regulations | Legal obligation |
| Assess job applications and manage recruitment | Legitimate interests, and steps towards a contract where we make an offer |
Where we rely on legitimate interests, we have considered whether our interests are overridden by your rights, and concluded they are not. You can ask us to explain that assessment, and you have the right to object (see section 8).
We do not use your information for marketing, and we do not track visitors to this website. See the Cookie Policy below.
4. Who we share it with
Engineering consultancy involves sharing information with third parties as a normal part of getting a project approved and built. Depending on the project, we may share your information with:
- Local planning authorities and highway authorities — for example Suffolk County Council, Babergh and Mid Suffolk District Councils, and other authorities relevant to the site
- Water and sewerage undertakers such as Anglian Water, in connection with drainage design and Section 104 adoption
- The Environment Agency and lead local flood authorities, in connection with flood risk assessments
- Other consultants on the project team — architects, planning consultants, ecologists, ground investigation specialists, contractors and their sub-contractors
- Our professional advisers — accountants, solicitors, insurers and insurance brokers
- Our IT and software suppliers, who host our systems and this website and may access personal data in the course of supporting them
Some information we submit to public authorities becomes part of a public planning record and will be published on that authority’s planning portal.
We do not sell your personal information, and we do not share it for third-party marketing.
5. Transfers outside the UK
Some of our IT suppliers process data outside the UK. Where that happens, we rely on UK adequacy regulations, or on the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses. You can ask us which suppliers this applies to and what safeguards are in place.
6. How long we keep it
| Record | Retention period |
|---|---|
| Website enquiries that do not become projects | 2 years from last contact |
| Project records and correspondence for contracts executed under hand | 6 years from completion, per the Limitation Act 1980 |
| Project records for contracts executed as a deed | 12 years from completion |
| Accounting and tax records | 6 years from the end of the accounting period, per HMRC requirements |
| Unsuccessful job applications | 6 months from the recruitment decision |
| Employee records | 6 years from the end of employment |
Because professional negligence claims in construction can arise long after completion, we retain project records for the full limitation period and, where a design has a long service life, sometimes longer. Where we keep records beyond these periods we do so on the basis of legitimate interests in defending potential claims.
7. How we keep it safe
We hold information on password-protected systems with access limited to staff who need it. We take regular backups, use up-to-date security software, and train our staff on handling personal information. Where we use third-party suppliers, we put written agreements in place requiring them to protect the information they process for us.
No system is completely secure. If a breach occurs that is likely to result in a risk to your rights, we will report it to the Information Commissioner’s Office within 72 hours and tell you directly where the risk is high.
8. Your rights
Under UK data protection law — the UK GDPR and the Data Protection Act 2018 — you have the right to:
- Be informed about how we use your information — that is what this notice is for
- Access the personal information we hold about you, and receive a copy
- Rectification — have inaccurate information corrected, or incomplete information completed
- Erasure — ask us to delete your information, where there is no continuing reason for us to hold it
- Restrict processing — ask us to pause using your information while a dispute about it is resolved
- Data portability — receive information you gave us in a portable format, where we process it by automated means on the basis of consent or contract
- Object to processing based on legitimate interests, including profiling
- Withdraw consent at any time, where we rely on consent — this does not affect anything done before you withdrew it
- Not be subject to solely automated decision-making with legal or similarly significant effects. We do not make such decisions.
To exercise any of these rights, email us at info@ingent.co.uk or write to us at the address in section 1. We will respond within one month. If a request is complex we may extend that by up to two further months, and will tell you if we do. There is no charge unless a request is manifestly unfounded or excessive.
Some rights are qualified. Where we cannot do what you ask — for example because we must retain records to comply with a legal obligation or to defend a claim — we will explain why.
9. Complaints
If you are unhappy with how we have handled your personal information, please tell us first so we can put it right.
You also have the right to complain to the Information Commissioner’s Office at any time:
- Website: ico.org.uk/make-a-complaint
- Helpline: 0303 123 1113
- Post: Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF
10. Changes to this notice
We review this notice periodically and will update it when our practices change. The date at the top shows when it was last revised. Material changes will be highlighted on this page.
